Welcome to AESHYO Cosmetics (“AESHYO”, “we”, “us”, or “our”).

AESHYO operates this store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”). AESHYO is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (the “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

Access and Account

To browse the Services or make a purchase, you may be asked to provide information such as your email address, billing address, payment information, and shipping information.

You agree that the information you provide is accurate, current, and complete, and that you have the right to provide it.

Where you use Shopify Customer Accounts or Shop, you are responsible for maintaining the security of your account credentials and for activity carried out through your account.

Our Products

We make reasonable efforts to present our products accurately in the Services. However, colours and product appearance may differ from how they appear on your screen because of your device, display settings, or configuration.

Product descriptions and availability may change without notice. We may discontinue a product at any time.

You must use AESHYO products only in accordance with the instructions supplied with the product.

Orders

When you place an order, you are making an offer to purchase the selected products.

Please review your order carefully before submitting it. Cancellation requests must be made within 12 hours of placing an order and before the order has shipped. A cancellation is not guaranteed until confirmed by AESHYO.

Once an order has shipped, it can no longer be cancelled. Returns and refunds are governed solely by our Return & Refund Policy.

Prices and Billing

All prices are displayed in US dollars (USD) and include applicable sales taxes.

Shipping costs are shown at checkout. Standard shipping costs $8.95, and shipping is free for orders with a merchandise value of $80.00 or more.

Prices, discounts, and promotions may change without notice. The price applicable to your purchase is the price displayed at the time you place your order.

You agree to provide accurate and complete purchase and payment information for all orders. Payment methods available at checkout include Shop Pay, PayPal, Visa, Mastercard, American Express, UnionPay, Apple Pay, Google Pay, and USDC.

Shipping and Delivery

We currently ship within the United States only. Orders ship from Texas via USPS Ground Service.

Orders received by 2:00 PM Central Time are usually shipped on the same business day. Most orders arrive within 2–3 business days, depending on the destination state. Delivery times are estimates and are not guaranteed.

Once an order leaves our warehouse, a tracking link is sent by email. Customers may use the tracking number to contact USPS customer service directly regarding the status of a shipment.

If a package is returned because the shipping address was incorrect, delivery was refused, or the package was not claimed, it may be resent only after the new shipping costs have been paid.

Intellectual Property

The Services, including their trademarks, brand names, logos, text, images, graphics, product reviews, videos, design, and arrangement, are owned by or licensed to AESHYO and are protected by applicable intellectual-property laws.

You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, republish, download, store, or transmit material from the Services without our prior written permission.

AESHYO names, logos, product names, designs, and slogans may not be used without our prior written permission.

Third-Party Services and Links

The Services may contain links to websites, tools, or content operated by third parties. We are not responsible for reviewing or evaluating third-party content, websites, products, or services.

If you access a third-party website or service, you do so at your own risk and subject to that third party’s terms and privacy practices.

Relationship with Shopify

AESHYO is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through this store are made directly with AESHYO.

Shopify is not responsible for any aspect of sales between you and AESHYO, including any injury, damage, or loss resulting from products purchased through the Services.

Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be processed by Shopify in accordance with the Shopify Consumer Privacy Policy.

By using the Services, you acknowledge that you have read and understood these privacy policies.

Feedback and Reviews

If you submit a review, feedback, suggestion, idea, or other content to us, you grant AESHYO a worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute, and display that content for operating, improving, and promoting the Services.

You are responsible for the accuracy and lawfulness of any feedback or review that you submit. You must not submit content that infringes another person’s rights, is unlawful, abusive, defamatory, misleading, or contains malware.

We may remove feedback or reviews that we determine, at our discretion, violate these Terms or applicable law.

Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, transit times, or availability.

We may correct errors, inaccuracies, or omissions and update information where necessary.

You may use the Services only for lawful purposes.

Use of AESHYO products is at your own risk. To the maximum extent permitted by applicable law, AESHYO is not liable for reactions, sensitivities, allergies, or other outcomes arising from use of a product, including outcomes arising from use that does not follow the supplied instructions.

Nothing in these Terms excludes any warranty or liability that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, AESHYO is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or replacement costs, arising from the use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold AESHYO harmless from claims, losses, damages, liabilities, and reasonable legal costs arising from your violation of these Terms, your violation of applicable law, or your infringement of another person’s rights.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law. The remaining provisions will remain in effect.

Entire Agreement

These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies posted on the Services, form the entire agreement between you and AESHYO regarding your use of the Services.

Governing Law and Jurisdiction

These Terms are governed by Swiss law.

The exclusive place of jurisdiction is Zurich, Switzerland, subject to any mandatory consumer-protection rights that apply to you.

Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted on this page with a revised “Last updated” date.
